The Surrogacy (Regulation) Act 2021 and the Assisted Reproductive Technology (Regulation) Act 2021 are two major legal reforms introduced in India to regulate fertility treatments and ensure ethical practices. The Surrogacy Act allows only altruistic surrogacy for Indian married couples, with strict eligibility rules for both intending parents and surrogate mothers. It bans commercial surrogacy to prevent exploitation and protect women’s rights.

On the other hand, the ART Act regulates fertility clinics and assisted reproductive technologies like IVF, ICSI, and donor procedures. It mandates proper registration of clinics, informed consent, and transparency in procedures. Both Acts aim to protect the rights of the child, the surrogate, and the intended parents.

Together, these laws promote ethical and safe practices in fertility treatments while curbing misuse and illegal practices. These regulations mark a significant step in bringing structure, accountability, and trust to India’s growing reproductive healthcare sector.
